Sexual Conduct in Senior Care Facilities: Legal Rights and Responsibilities will be the topic presented by nurse-attorney, Carolyn Rosenblatt, and elder care psychologist, Dr. Mikol Davis at the National Council on Aging/American Society on Aging conference, Aging in America, in Chicago on March 15, 2010. They, together with RN geriatric care manager, Tina Cheplick, will discuss the law, consent to sexual conduct in persons with cognitive impairment, and the responsibilities of care facilities about sexual conduct. This thorny and controversial subject is becoming a frequent topic of discussion in facilities, which have historically had trouble fully facing the need for clear policies about elders and sex. Families, too, have concerns about their aging loved ones in care facilities, and their rights about parents’ sexual conduct will also be discussed.

The emotional and psychological needs of aging persons, the role of care facility administrators and staff, and the rights of elders will be explored. Attendees will learn about balancing the rights of the elder against the responsibility of the facility to keep them safe. They will learn assessment methods in determining whether an elder is capable of giving consent and guidelines for establishing facility policy about sexual conduct.
